The school bus proceeded to collide head-on with a Nissan Titan pickup truck. Paramedics were called to the scene of the accident to help all of the victims.
The driver of the Nissan Titan pickup truck was transported to the hospital with serious injuries. Another 30 children were also hospitalized in the crash.
A full investigation into the Evans County school bus accident remains ongoing.
School buses are considered common carriers in Georgia. They are expected to exercise a great deal of care to protect the safety of their passengers. Pursuant to O.C.G.A. § 40-6-48, “A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.” There are many ways that a school bus driver may have acted negligently and contributed to a collision.
If a school bus driver encounters some type of emergency on the bus, they must safely pull the bus over to the side of the road and seek further assistance. There is simply no excuse for a bus driver to allow their vehicle to enter into opposing lanes of traffic. When a school bus driver is negligent and causes a collision, the company or school district that they worked for could also be held at fault. As a general rule, employers are liable for the wrongful actions of their workers.
School buses are typically very safe for their passengers. But they can be uniquely dangerous for those in passenger vehicles. According to the NHTSA, “From 2008 to 2017, there were 317,994 fatal motor vehicle traffic crashes. Of those crashes, 1,113 (0.4%) were classified as school-transportation-related. Fifty-two percent of school-transportationrelated crashes from 2008 through 2017 occurred in rural areas.” Several steps should be taken to prevent school bus accidents.
The FMCSA requires buses that can carry 16 or more passengers to have at least $5,000,000 in liability coverage. This can be used to help accident victims recover for all of their lost wages, medical bills, and pain and suffering. Unfortunately, school districts will often do everything in their power to deny responsibility if one of the drivers causes a crash. This is where an Atlanta school bus accident lawyer can help. They can take steps to ensure that evidence is protected and that your rights are being upheld.
