DALLAS, GEORGIA (October 8, 2025) – A 12-year-old girl identified as Claudia Bacon was critically injured in Dallas after being hit by a falling tree limb at the Paulding Meadows Art Festival.

Paulding County officials are saying that the accident took place on Saturday, September 6. Claudia Bacon was hit by a falling tree branch at the festival.

It remains unclear what caused the tree branch to fall. Paramedics were called to the scene of the accident to help the victim.

Claudia Bacon was rushed to the hospital with critical injuries. She sustained a fracture to her skull and was placed on a ventilator.

Her condition continued to improve after therapy and support from her family.  She has since returned home.

Liability for Accidents Involving Falling Tree Branches

Property owners have a legal obligation to protect against reasonably foreseeable sources of harm. This includes protecting against accidents where a tree branch falls and injures a guest. Many people will label accidents involving falling trees or tree branches as unforeseeable acts of nature. But the fact of the matter is that these accidents are often predictable and may impose liability on property owners. What follows are just a few of the measures that property owners should take to protect guests from accidents with their trees.

  • Inspections: Property owners should routinely inspect all of the trees on their property. If they are not able to do this, they should hire a certified arborist.
  • Maintenance: Property owners should perform required maintenance on their trees. This includes removing dead or diseased branches.
  • Design: Property owners should avoid putting benches and picnic tables under large overhanging branches.

Many property owners have faced lawsuits after guests have been injured by falling trees or branches. Consider, for example, City of Fitzgerald v. Caruthers. A man was seriously injured in Georgia after a decayed tree limb fell on top of him. Attorneys for the plaintiff argued that the city was liable for the accident for failing to remove the tree limb. In that case, damage to the tree limb was visible. It also existed for a sufficiently long period of time that the city should have known about it and taken action. A jury verdict for the plaintiff was upheld by the Court of Appeals of Georgia.

Signs That a Tree Is in a Dangerous Condition

Many people are injured in accidents involving falling trees each year. According to The Weather Channel, “Multiple people are killed each year due to falling trees during storms or other weather, but there is no good record of the exact number.” There are many different signs that a tree is in a dangerous condition and likely to fall.

  • Structural Damage: A tree may have visible structural damage, including cracks or splits along major limbs.
  • Root Problems: The roots on a tree may be exposed or otherwise show signs of serious decay.
  • Disease: A tree may be infected with a disease. Signs of disease include discolored or oozing bark.
  • Species: Certain trees are prone to tipping over and are therefore not ideal for high-traffic pedestrian areas.

Accidents involving falling trees can leave victims with serious and lasting injuries. Children can be particularly vulnerable. It is important for accident victims to understand that they do have legal rights. They are able to pursue damages through a personal injury claim. Damages can help cover all of the bills and expenses that accrue as the result of an injury. A premises liability attorney can examine the unique facts of your case free of cost and let you know what your legal options are.
