Liability for Brookhaven Dump Truck Accidents
Dump truck drivers are required to obtain a commercial license and must operate with a great deal of caution to avoid colliding with pedestrians. According to GA Code § 40-6-91, “The driver of a vehicle shall stop and remain stopped to allow a pedestrian to cross the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching and is within one lane of the half of the roadway on which the vehicle is traveling or onto which it is turning.” Several factors could contribute to any dump truck accident.
- Speeding: Many dump truck collisions are due to speeding. Even traveling the speed limit at certain locations could be dangerous, depending on the prevailing conditions.
- Driver Intoxication: Dump truck drivers may be intoxicated by alcohol or other substances. What many drivers do not realize is that a variety of substances, including prescriptions, could impair their ability to drive safely.
- Driver Distraction: Truck drivers may be distracted by their phones or other objects. In particular, drivers are more likely to crash if they are reaching for fallen items.
When a dump truck fails to slow down to avoid colliding with any pedestrian, this could be construed as negligence. Depending on the facts of any case, liability for a pedestrian accident could extend beyond any driver deemed to be at fault. The employer that a dump truck driver worked for could also be legally responsible. Employers in Georgia can be vicariously liable for the wrongful actions of their workers who were operating within the course and scope of their job duties.
Preventing Georgia Dump Truck Accidents
Dump truck accidents across Georgia and the United States are often highly preventable. According to the Engineering News Record, “Serious accidents involving dump trucks and ready-mix concrete delivery trucks continue to edge up, part of a persistent, multi-industry problem with poor driving habits that has not yet responded to increased fleet and vehicle insurance premiums.” Truck companies should take certain steps to prevent these collisions.
- Training and Monitoring: Dump truck companies should ensure that all of their drivers are properly trained and adequately monitored. Employers should take corrective action if they detect unsafe habits.
- Vehicle Maintenance: Dump trucks should be routinely inspected and well maintained. This is particularly important for the brakes and engine of the dump truck.
- Technology: Dump truck companies should consider equipping their vehicles with technology to help prevent collisions. This can include forward collision avoidance systems and blind spot detectors.
Companies that operate dump trucks and their drivers will almost never accept responsibility for collisions. This is why it is so critical for these accidents to be thoroughly investigated by an outside party. Evidence from the scene can help establish what caused a collision and what a truck driver may have been doing in the moments leading up to any incident. It is important for victims and their family members to understand that they do have rights. The family of any person who died in a dump truck collision may have legal recourse through a civil claim.
