Liability for Bibb County Truck Accidents

Truck drivers must exercise a great deal of care to avoid colliding with pedestrians. Pursuant to GA Code § 40-6-93, “Notwithstanding other provisions of this chapter, every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian upon any roadway, shall give warning by sounding his horn when necessary, and shall exercise proper precautions upon observing any child or any obviously confused, incapacitated, or intoxicated person.” Truck drivers should take several actions to avoid hitting pedestrians.

  • Blind Spots: Truck drivers should always check their blind spots before changing lanes or making turns at intersections.
  • Reduced Speed: Truck drivers may need to dramatically reduce their speed to account for traffic or weather conditions.
  • Fatigue Management: Truck drivers should take periodic breaks to ensure that they are well rested and alert.

If a truck driver was working as an employee at the time of a collision, the company that they were working for could be held at fault. Generally speaking, employers are vicariously liable for the wrongful actions of their workers, insofar as those workers were operating within the course and scope of their employment. However, many truck companies hire their drivers as independent contractors to limit their legal exposure for collisions.

Common Causes of Truck Accidents

Truck accidents tend to be highly complex events. The factors that contribute to any truck accident could take place a few hours or months before the actual event. There are many factors that may contribute to any truck accident.

  • Speed: Trucks can weigh as much as 80,000 lbs. If a truck driver is not traveling at a safe speed, they may not have sufficient time to react to hazards in the road.
  • Inclement Weather: Poor weather conditions can reduce the visibility of pedestrians and make it much more difficult for truck drivers to stop.
  • Fatigue: The Centers for Disease Control estimates that staying awake for only 17 hours can reduce a person’s ability to operate their vehicle safely equal to driving with a blood alcohol concentration of 0.05%.
  • Driver Distraction: Any type of activity that forces a driver to remove their eyes or attention can dramatically increase the odds a collision will take place.

Truck accidents are often highly preventable. They tend to involve situations where truck drivers are simply not paying adequate attention to the road ahead of them. Even if a pedestrian is in the middle of the road, truck drivers should still be able to brake in time to avoid colliding with them.
