Every driver in Georgia must use caution to avoid colliding with any pedestrian in the roadway. Pursuant to O.C.G.A. § 40-6-93, “Notwithstanding other provisions of this chapter, every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian upon any roadway, shall give warning by sounding his horn when necessary, and shall exercise proper precautions upon observing any child or any obviously confused, incapacitated, or intoxicated person.” There are many ways that a driver’s negligence may have contributed to a collision.
The vast majority of pedestrian accidents are preventable. Drivers must slow down to avoid pedestrians, even if they are in the middle of the road. Failing to slow down to avoid colliding with a pedestrian could form the basis of a negligence claim. It is essential that evidence is properly preserved after any collision. The evidence left behind after a crash can help paint a clear picture of what happened.
It is possible that there could be several liable parties for any pedestrian accident. In particular, an accident may have involved a driver who was working at the time of a collision. This becomes more likely when the vehicle involved is a van or pickup truck. These vehicles are used for a variety of commercial purposes.
In Georgia, employers are held vicariously liable for the wrongful actions of their workers–insofar as those workers were operating within the course and scope of their job duties. It is important for accident victims to understand that they do have legal rights. They are able to seek some measure of justice through a civil claim.
We at Butler Kahn extend our best wishes to Tracy Saunders and her family as she continues to recover. It is our sincere hope that she is able to make a full recovery. There needs to be a thorough investigation into what went wrong. Many questions remain unanswered at this time. What was the speed of the truck driver prior to the collision? Did they even attempt to brake to avoid a crash?
