What does “negligence” mean in a personal injury case?
Negligence is when a person or a company does something wrong which causes someone else an injury. To show negligence in a personal injury lawsuit, the plaintiff must show:
- that the wrongdoer had a duty to the plaintiff,
- the wrongdoer breached that duty,
- the wrongdoer’s negligent action caused the plaintiff’s injury, and
- the plaintiff suffered harm.
