Deposition of Dr Michael Yablick – Butler Kahn
This is the for-trial deposition of Dr. Michael Yablick, an ophthalmologist. BLF took the deposition of Dr. Yablick because he was the first doctor to see our client’s eye injury after our client was struck by a defective firework. In this deposition, Dr. Yablick describes our client’s injuries as seen by Dr. Yablick almost immediately after the firework accident, as well as the emergency surgery Dr. Yablick perfromed on our client to explore his eye for additional damage and close cut on his eyelid. At trial, BLF used this deposition as evidence of our client’s past pain and suffering and other damages.

â–º A. Michael Yablick.
â–º Q. And what’s your current occupation?
â–º A. I’m an ophthalmologist.
â–º Q. Where do you currently work?
â–º A. I work in Sun Prairie, Wisconsin, with Davis Duehr Dean Eye Care.
â–º Q. And at all times relevant to this case, did you practice medicine in Chattanooga, Tennessee?
â–º A. I did.
â–º Q. And are you currently licensed to practice medicine in Tennessee?
â–º A. I currently am.
â–º Q. Where do you live currently?
â–º A. I live in Columbus, Wisconsin.
â–º Q. And in 2018 was Mr. your patient?
â–º A. Yes.
â–º Q. How long have you been an ophthalmologist?
â–º A. I have been practicing since 2015; so almost six years now.
â–º Q. Do you have an active ophthalmology practice in which you see patients throughout the week?
â–º A. I do.
â–º Q. Are you on call at times for a trauma center?
â–º A. Yes.
â–ºQ. What does it mean to be board-certified in a particular field of medicine?
â–ºA. It means that you have undergone adequate residency training in that particular field as well as, I would assume in most fields, undergone some sort of examination testing general knowledge in that field.
â–ºThose are generalities from ophthalmology, at least.
â–ºQ. Are you board-certified in ophthalmology?
â–ºA. I am.
â–ºQ. Could you tell me a little bit about your educational background?
â–ºA. Sure. I did undergraduate work at Millsaps College in Jackson, Mississippi, where I received a bachelors in biology. Subsequently did my medical training at the University of Alabama in Birmingham at the medical school there. I did a year internship in Montgomery, Alabama, in internal medicine, three years of ophthalmology residency in Richmond, Virginia, and I did an additional year fellowship training in New Orleans, Louisiana.

â–ºQ. So, first, I’d like to ask you a little bit about medical treatment. In addition to providing medical treatment yourself, have you reviewed some of his medical records?
â–ºA. I have reviewed some of them, yes.
