â–º How long does a sexual assault or rape case take? Well, it depends very heavily on the facts of that case. It depends on what happened, and what the evidence is, and what the financial setup of the defendant or the insurer is. But we can divide cases into two categories in terms of the time that they take.
â–º Some cases settle for the full insurance limits relatively quickly. If it’s a case where the entirety of the insurance limits are going to be paid, maybe it’s a business that has a $1 billion commercial general liability policy. Then collecting that policy limit may not take that long in the relative sense of how long civil lawsuits can take. Cases like that, and this is a rough estimate, but they may run five to seven months, something like that.
â–º In other cases, particularly those where frankly, the pot of available money is larger, and we’re able to collect something approximating the full value of the case, that can take a lot longer because if there’s an insurance company or a business or something out there who’s going to have to pay out a lot of money, they tend to fight for a long time. So those cases go on longer. The good news is that’s usually because we’re going to end up with a stronger result in the end, but cases like that, they’re hard to estimate too. But two to three years is not a bad estimate.
